Can an American Buy a Vacation Home in France?

But is it easy for Americans to buy a vacation home in France? Legal Requirements


Exploring the possibility of owning a vacation home in France is an exciting prospect, and while there are no general restrictions for Americans purchasing French real estate, there are several steps involved to ensure a smooth legal journey to ownership…

1. Property Selection: The first step in the process is to find a French holiday home that meets all of your personal requirements. From city boltholes to rural farmhouses, searching with the help of a local estate agent can help narrow down the selection, and ensure you’re searching for a legally compliant property.

2. Preliminary Agreement (Compromis de Vente): Once you’ve found the home, in France it’s customary to sign a Compromis de Vente, a preliminary, legally-binding contract that serves as a sale agreement. In order to complete the paperwork, you’ll need to provide identification and prove financial capability before paying a deposit of 5-10%.


3. Final Contract (Acte de Vente): The process then moves onto the preparation of a final contract or Acte de Vente. This can take several months to complete, and includes checking land records and verifying the property’s legal status.

4. Payment: Once the final contract has been signed (which must be witnessed by a notary), all that is left is for the remaining balance to be paid, alongside any additional fees and taxes. A proof of payment must then be shared among all parties.

5. Transfer of Ownership: The notary is responsible for registering the sale, before the new buyer receives an official title deed, becoming the proud owner of a second home in France. 

Associated Costs

With the buying process outlined above, it’s also worth considering the additional costs involved in addition to the purchase price. In France, legal fees tend to range from 6-8% of the property's total value, covering crucial notary fees. Buyers also face taxes such as stamp duty and registration, which can add another 5-7% overall. 

Once the property becomes your own, there will also be several ongoing fees to cover. Annual property taxes, including the French taxe foncière and taxe d'habitation, vary depending on the property's location and size. Maintenance costs, including utility bills and property management if required should also be considered. Of course, American citizens will also need to factor in currency exchange and the cost of international money transfers.
